You may use the Services solely for your personal and non-commercial use. You agree to access or use the Services solely for legal purposes. You agree not to:

Terms of Sale & Pricing

By placing an order with Crown & Root Botanica, you are offering to purchase a product, representing that you are of legal age, and confirming that the payment and shipping information you provide is true and accurate.

  • Order Acceptance: We reserve the right to refuse, limit, or cancel any order for any reason, including limitations on quantities available for purchase or inaccuracies in product or pricing information.

  • Product Display: We make every effort to display our products, matte black vessels, gold filigree labels, and bamboo lids as accurately as possible. However, actual colors may vary depending on your device display.

  • Risk of Loss: The risk of loss and title for products purchased pass to you upon delivery of the product to the carrier.

Disclaimer and Limitation of Liability

The Services and all products provided by Crown & Root Botanica are offered on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied.

To the fullest extent permitted by law, Crown & Root Botanica shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or connected with your use of the Services or the purchase of any products. Our total aggregate liability to you for any claim arising from these Terms or your purchase shall not exceed the amount paid by you for the applicable product(s) or $50, whichever is greater.

(Note: Proper candle safety guidelines, including trimming wicks to 1/4 inch and never leaving a burning candle unattended, should always be followed. Crown & Root Botanica assumes no liability for misuse of our products.)

Indemnity

You agree to indemnify, defend, and hold harmless Crown & Root Botanica, its owners, officers, and employees from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of our products or Services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms must be brought exclusively in the state or federal courts located in Johnson County, Kansas.
